NYT:

Defense lawyers in some of the country's biggest terrorism cases say they plan to bring legal challenges to determine whether the National Security Agency used illegal wiretaps against several dozen Muslim men tied to Al Qaeda.

The lawyers said in interviews that they wanted to learn whether the men were monitored by the agency and, if so, whether the government withheld critical information or misled judges and defense lawyers about how and why the men were singled out.

The expected legal challenges, in cases from Florida, Ohio, Oregon and Virginia, add another dimension to the growing controversy over the agency's domestic surveillance program and could jeopardize some of the Bush administration's most important courtroom victories in terror cases, legal analysts say.

So Bush's Peep-Show jeopardizes our ability to prosecute terrorists. That's okay. In this country, if we don't like the way a trial turns out, we just have the President throw the perpetrator in the pokey regardless.

It's why we fought Britain for our independence, to have this kind of government.

Defendents freed by illegal actions

This is the base problem with the questionable legal tactics Bush has claimed since 9-11. All of the evidence gathered through torture, renditions, spying, etc is inadmissible in a court, which therefore forces further illegal torture, renditions, detainments, and spying.

There is no way to "launder" evidence gained through these methods.

Thus, if you were to catch a terrorist based on this info, your only choice left is indefinite illegal detention.

All hail to the chief. Throw the terror suspects in the brig. The day will come when the infidel arabs will throw down their AK47s, IEDs, and RPGs and surrender to the infusion of western democracy. May they retreat back to the caves and live out their tired outdated lives among the dust from which they came.
